This paper will explain the basic notions of solve et repete, exhibiting the cases in which this requirement established by the lawmaker is in force in the exercise of special actions of a contentious-administrative nature, expressing what both the Constitutional Court and specialised doctrine have stated in this regard, and finally explaining the reasons why it should be eradicated from our legal system, especially considering the right of the defendants to have effective access to justice.En este trabajo se explicarán las nociones básicas del solve et repete, dando a conocer los casos en los que está vigente esta  exigencia establecida  por  el legislador  ante  el  ejercicio de acciones especiales  de carácter  contencioso administrativas, expresando lo que ha  señalado al respecto tanto el Tribunal Constitucional como la doctrina especializada, y exponiendo finalmente las razones por las cuales debe ser erradicada de nuestro ordenamiento jurídico, considerando especialmente el derecho de los justiciables de tener un efectivo acceso a la justicia.
