Article 1945 of the Chilean Civil Code makes the leaseholder, liable for in advanced ending, forcing them to pay all the rents until the lease is up. As in certain cases, the amount to be paid by the leaseholder may be excessive, this paper proposes adapted criteria to limit or reduce this liability. To that end, it is necessary to previously determine the nature of the obligation of paying rent (compliance or compensation).El artículo 1945 del Código Civil chileno impone al arrendatario, responsable del término anticipado, la obligación de pagar la renta hasta la fecha que el contrato hubiere podido cesar. Debido a que, en determinados casos el monto a pagar por el arrendatario puede resultar excesivo, se proponen los criterios adecuados para su limitación o reducción. Para tal efecto, es necesario determinar, en forma previa, la naturaleza de esta obligación de pago de renta (cumplimiento o indemnización).
