Abstract
This article addresses an issue of constant controversy in courts of law, concerning the possession of notorious civil status, analyzing its origin and evolution, seeking to determine its legal nature, is it an institution or a means of proof?, If the primacy of biological tests are in accordance with our Charter, and the possible collision of right. We will analyze the different aspects that comprise the right to identity and its relation to the notorious possession of civil status. Finally, it is the procedural way of claiming Is it possible to allege the possession of notorious civil status as the basis of a claim action or challenge? En este artículo se aborda un tema de constante controversia en los tribunales de justicia, lo relativo a la posesión notoria del estado civil, analizando su origen y evolución, buscando determinar su naturaleza jurídica, si se trata de una institución o un medio de prueba, si su primacía por sobre las pruebas biológicas son acordes a nuestra Carta Fundamental, y la eventual colisión de derechos. Analizar las distintas Faz que comprende el derecho a la identidad y su relación con la posesión notoria del estado civil. Finalmente, se tratará la forma procesal de alegarla ¿Es posible alegar la posesión notoria del estado civil como fundamento de una acción de reclamación o impugnación?
