That is why it is important to review the importance of this action, its discussion on its legal nature, which  established the Supreme Court in its regard, and then finally analyze whether or not this action for the case AC Inversions, which explodedin March This year, similar in nature to the Inverlink case.El tema de la naturaleza de la acción por provecho del dolo ajeno es un asunto muy controvertido; entre si es una acción de indemnización o una acción de restitución, ya que tiene efectos prácticos muy diversos. Pero cuando tomó un interés jurisprudencial fue en el caso Inverlink, donde la Corporación de Fomento se vio obligada a demandar civilmente a todos aquellos inversionistas (ajenos al grupo Inverlink) que retiraron sus inversiones de manera anticipada, sin saber que el dinero con el que se concretaron esos rescates fueron fondos sustraídos a la CORFO. Es por ello que conviene revisar la importancia de esta acción, su discusión alrededor de su naturaleza jurídica, lo que estableció la Corte Suprema a su respecto, para después finalmente analizar si procede o no esta acción para el caso ACInversions, que explotó en Marzo de este año, de naturaleza similar en cierto modo al caso Inverlink.
