| dc.description | There are damages caused by a certain group of people, in which it can be established that the harmful action is produced by one of the members of the group and that any of them, given their behaviour, could have caused it, although it is impossible to identify the guilty or responsible. In the context of violent demonstrations, criminal acts have occurred, where it is often not possible to identify the tortfeasor or tortfeasors causing damage, but it is possible to identify the group or group of individuals, including the perpetrator or perpetrators who committed the harmful action. This situation raises the problem of whether and how the victim can be compensated. This paper deals with the problem of the damage caused by an unknown perpetrator who belongs to a certain group, but for a specific case and, in general, neglected by the doctrine: the damage caused in demonstrations or protests. | en-US |
| dc.description | Hay daños causados por un grupo determinados de personas, en que se puede establecer que la acción dañosa se produce por alguno de los miembros del grupo y que cualquiera de ellos, dado su comportamiento lo hubiera podido causar, aunque resulte imposible la identificación del culpable o responsable. En el marco de manifestaciones violentas, se han producido actos delictivos, donde muchas veces no es posible identificar al o los causantes del daño, pero sí al grupo o conjunto de sujetos, dentro del cual se encuentran el o los autores que cometieron la acción dañosa. Esta situación plantea el problema si la víctima podrá ser resarcida y de qué forma. El presente trabajo aborda el problema del daño causado por un autor desconocido que pertenece a un grupo determinado; pero para un supuesto específico y, en general, descuidado por la doctrina: los daños causados en manifestaciones o protestas. | es-ES |
