Abstract
The objective of this paper is to carry out a critical analysis of the application of the reduction of sentence by one degree established in article 21 of the Law on Adolescent Criminal Responsibility (LRPA) to determine the nature of the crime, and its impact on the statute of limitations regarding sexual crimes committed by adolescents. For this purpose, all the judgments pronounced by the Supreme Court during the year 2025 that accepted amparo appeals filed in favor of adolescents accused of these crimes were analyzed, where a defined jurisprudential criterion is observed regarding the technical problem in question. In the face of the interpretative ambiguity of the norm, the authors provide normative, systematic and political-criminal arguments that allow the reasoning followed by the Supreme Court to be rejected in a well-founded manner, maintaining, in short, that the classification between crimes, simple offenses and criminal offenses committed by adolescents must be carried out in accordance with the penalty in the abstract that the law indicates.
 
El presente trabajo tiene por objetivo realizar un análisis crítico al momento de aplicación de la rebaja de pena en un grado establecida en el artículo 21 de la Ley de Responsabilidad Penal Adolescente (LRPA) para determinar la naturaleza del delito, y su impacto en el plazo de prescripción respecto a delitos sexuales cometidos por adolescentes. Para tales efectos, se analizaron todas las sentencias pronunciadas por la Corte Suprema durante el año 2025 que acogieron recursos de amparo interpuestos en favor de adolescentes imputados por estos ilícitos, donde se observa un definido criterio jurisprudencial respecto al problema técnico señalado. Frente a la ambigüedad interpretativa de la norma, los autores entregan argumentos normativos, sistemáticos y político criminales que permiten rechazar de manera fundada el razonamiento seguido por el Máximo Tribunal, sosteniendo, en definitiva, que la clasificación entre crímenes, simples delitos y faltas cometidos por adolescentes debe efectuarse conforme a la pena en abstracto que la ley señale.
