| dc.description | El trabajo critica la opinión de Claro Solar, en orden a que en el Código Civil por regla general las expresiones "transferir" y "transmitir" mientan respectivamente los traspasos entre vivos y por causa de muerte, porque el examen de tales expresiones en la ley no corrobora esa opinión. A la luz de ello, se examina el artículo 703 inciso 3º CC., en donde se contiene la definición de título traslaticio de dominio, como aquel apto para transferirlo, que usualmente se entiende excluir a la sucesión por causa de muerte (herencias y legados) del concepto de tal título, por no consistir ella en una transferencia, sino en una transmisión; y se propone reinterpretarlo en orden a que la palabra "transferirlo" usada en la definición también incluye a la sucesión. | es-ES |
| dc.description | This paper criticizes Claro Solar’s opinion on the expressions "transfer" and "transmit" in the Civil Code which gene-rally lie about the transfers among the living and upon death, since the analysis of such expressions in the law does not corroborate that opinion. In light of this, this paper presents a look at Art. 703, subsection 3d CC, where the definition of deed of conveyance can be found, as such suitable for being assigned, which is usually understood as excluding the succession upon death (inheritances and legacies) of the concept of such a deed, because it does not constitute a transfer, but a transmission; moreover, a reinterpretation of it is suggested in that the words "transfer it," used in the definition, also includes the succession. | en-US |
