El presente estudio tiene por objeto dar a conocer los aspectos más relevantes del nuevo sistema de protección frente al desempleo implementado en Chile, centrando el análisis en un aspecto interesante introducido por la Ley Nr. 19.728, cual es, la vinculación de las prestaciones sociales por la pérdida del empleo, en los casos en que éstas se pagan con cargo al Fondo de Cesantía Solidario, con la obligación del trabajador cesante de participar en los programas de empleo y de capacitación ofrecidos por las Oficinas de Intermediación Laboral. Esta fórmula incorporada por la Ley de Seguro de Desempleo de manera tangencial y particularizada a las prestaciones con cargo al Fondo de Cesantía Solidario, produce un cambio significativo en nuestro sistema de seguridad social, ya que vincula estrechamente el otorgamiento de prestaciones sociales con una política activa de empleo y con una obligación específica para los beneficiarios, en cuanto éstos tienen el deber de hacer uso de los mecanismos de intermediación y de capacitación laboral que proporciona el Estado para facilitar su reinserción en el mercado de trabajo.  The aim of this article is to inform about the most relevant features of the new protection system implemented in Chile in the face of unemployment. The analysis focuses on a very interesting point introduced by Law Nº 19.728: the link between unemployment benefits, when paid by charging the Fondo de Cesantía Solidario [Solidarity Funds for the Unemployed] for them, and the duty of the unemployed worker to participate in the employment and training schemes offered by the Oficinas de Intermediación Laboral [Bargaining Units]. This formula incorporated by the Unemployment Insurance Law in an incidental and detailed way into the social security benefits chargeable to the Solidarity Funds for the Unemployed causes a profound change in Chile’s social security system, because it directly links the grant of social benefits with both an active employment policy and the beneficiaries’ specific obligation to make use of the bargaining mechanisms and of the skills training provided by the State in order to facilitate their reinstatement in the labor market.
