| dc.description | El trabajo aborda, desde una perspectiva crítica, el tema de la ejecución de las penas con base en el ordenamiento jurídico chileno. Explica la necesidad de centrar la atención en este aspecto del ejercicio de la potestad penal del Estado –tanto en el plano dogmático, como en el normativo–, fundamentalmente a raíz del detrimento que pueden sufrir los derechos del individuo con motivo de la ejecución de la condena; expone las razones que justifican la judicialización de la ejecución penitenciaria y se refiere al tipo de órgano que debería quedar a cargo de este cometido. Sobre la base de esas reflexiones examina la situación de la etapa ejecutiva desde la entrada en vigencia del Código Procesal Penal y llama la atención sobre la necesidad de acometer una completa revisión del tema, tal como ocurrió durante los últimos años con los aspectos procesales y como actualmente sucede con el derecho penal sustantivo. | es-ES |
| dc.description | From a critical perspective, this paper addresses the enforcement of penalties in light of the Chilean legal system. It explains why it is necessary to focus the attention on this aspect of the practice of the State’s penal authority, both on a dogmatic level as well as on the regulatory level, mainly because of the potential violation of the rights of the convicted upon carrying out their sentences. It presents the reasons that justify the "judicialization" of the penitential enforcement, and it also refers to the kinds of entity to which this role should be assigned. Based on these considerations, it explores the situation of the enforcement stage from the entry in force of the Criminal Law and advises about the need for addressing a thorough review of the issue, just as it happened with the procedural aspects in the last few years and with the substantive criminal law nowadays. | en-US |
