dc.descriptionLos delitos de obstrucción a la justicia son figuras que atentan contra la Administración de Justicia y que, además, generalmente se legitiman por la infracción al deber que subyace como fundamento del tipo. Desde esta perspectiva se analiza por separado las tres formas del delito que están contenidas en los artículos 269 bis y 269 ter: a) rehusar a proporcionar a los tribunales de justicia antecedentes conocidos o que se posean y que permitan establecer la existencia de un delito o la participación punible en él; b) destruir, ocultar o inutilizar el cuerpo, los efectos o instrumentos de un crimen o simple delito, con posterioridad a su descubrimiento; y c) ocultar, alterar o destruir cualquier antecedente, objeto o documento que permita establecer la existencia de un delito, la participación punible en él, o que pueda servir para la determinación de la pena, si el que lo hiciere fuere un fiscal del Ministerio Público.es-ES
dc.descriptionCrimes relating to the obstruction of the course of justice are figures that attempt against the administration of justice and that, generally, become legitimate because of the breach of duty that underlies as grounds for this offense. From this perspective, the three patterns of the offense included in Articles 269 (Amend. 2) and 269 (Amend. 3) are analyzed; (a) to refuse to provide the courts of justice with known background or that are known and help determine the existence of an offense or the punishable participation in it; (b) to destroy, conceal or make useless the body, the effects or instruments of an offense or misdemeanor subsequent to its detection; and (c) to conceal, alter or destroy any background, object or document that help determine the existence of an offense, the punishable participation in it or that may be useful for the determination of the penalty, if committed by an Office of the Attorney General prosecutor.en-US
