La discusión actual sobre modelos institucionales asociados al mal funcionamiento y poca eficiencia del poder judicial abarca materias desde el acceso a la justicia, mecanismos alternativos hasta la legitimidad y aceptación de la decisiones. El origen de los Medios Alternativos de Resolución de Conflicto (MARC) difiere en las experiencias de los países del sistema Continental Europeo (donde tomamos como ejemplo a Alemania) del tenido en los Estados Unidos de América. Si se quiere dar cabida (obligatoria, facultativa) a los MARC, se debe prestar atención a su relación con el proceso civil, y en este trabajo así lo tratamos. No creemos que podamos hablar de algo "alternativo" al proceso civil por su estructura y fines. El proceso civil tiene que alcanzar sus metas según la "justicia procesal", que ofrece una teoría adecuada para el resguardo del derecho material y la resolución de conflictos, colaborando por consecuente a resolver conflictos, a la paz social y al perfeccionamiento mismo del Derecho. La idea base detrás de la necesidad de actuación y realización jurisdiccional del Derecho es la legitimidad de la sentencia fundada en la participación, el perfeccionamiento y la tutela del derecho material. Presentamos preguntas abiertas desde el proceso civil sobre los MARC, la resolución de conflictos, la relación entre el derecho material-formal y el proceso legal.Much contemporary discussion in this field, and associated projects of institutional design, are taking place under the wide ranging but imprecise label of the Judiciary and its efficiency (from access to justice and the adjudication legitimacy). The reasons of origins and development of ADR are different in Civil Law (we explain the Germany experience) and American Law. If a common linking theme is sought, we argue that this must lie in a general shift of priorities as between judgement and settlement in ideological comparative terms in regards of the civil procedure. It is not right to present a "alternative" to legal process, when we are treated different institutes. The civil procedure has to achieve their goals according to the "Procedural Justice", which offers a theory of procedural fairness for civil dispute resolution. The core idea behind the theory is the procedural legitimacy thesis: participation rights are essential for the legitimacy of adjudicatory procedures. The theory yields two principles of procedural justice: the accuracy principle and the participation principle. This paper presents open questions about the conflicts resolution, the relation between substantial and formal law and the legal process.
