dc.descriptionEl artículo examina el actual estado de la noción de causa como función económico-social del acto de autonomía privada que, sobre la base de ideas procedentes de Emilio Betti, acogió el Codice Civile de 1942 y, a partir de éste, la doctrina civilística italiana inmediatamente sucesiva. la crisis de ese concepto proviene de su casi exclusivo servicio a la integridad del ordenamiento jurídico en relación con los actos de autonomía privada y su desentendimiento de la tutela práctica del interés particular de los autores de esos actos. lo cual se pone en paralelo con el fenómeno de la decadencia misma del concepto y hasta con su desaparición en algunos códigos recientes y en los proyectos europeos de Derecho unificado de contratos. se sugiere que un replanteamiento de la noción debe tener en cuenta esta experiencia y, sin abandonar las finalidades tutelares del ordenamiento por parte de la causa, debe también tener en cuenta las finalidades protectoras del interés individual.es-ES
dc.descriptionThis paper discusses the state-of-theart notion of "cause" as a socioeconomic function of the act of private autonomy that, based on Emilio Betti’s ideas, was included in the 1942 Codice Civile and, from this, the immediately subsequent Italian civilistic doctrine. The crisis of such a concept comes from its almost exclusive service to the integrity of the judicial system in relation to the acts of private autonomy and its unconcern with the practical protection of the particular interest of the authors of such acts. The above is in tandem with the phenomenon of the decadence of this concept and, even with its disappearance from some recent codes and from the European projects of unified contractual law. It is suggested that a reformulation of this notion must consider this perception and, without leaving out the protective aims of the system on the part of the cause, must also consider the protective aims of the individual interest.en-US
