| dc.description | Este trabalho, em um primeiro momento, aborda a livre concorrência no ambiente comunitário sob a perspectiva da filosofia. Para tanto, submete a livre concorrência à análise de três correntes filosóficas, no intuito de sustentá-la como uma verdadeira manifestação de liberdade. E em um segundo passo, corroborado pela autoridade do argumento filosófico desenvolvido, busca demonstrar que a liberdade de as empresas concorrer durante o processo de integração econômica entre países, faz parte da estrutura da ordem comunitária focada em uma economia de mercado. Nessa perspectiva, o trabalho analisa os Tratados de Assunção e Roma e conclui que a limitação da liberdade de concorrência por normas reguladoras não a descaracteriza como uma liberdade, nem como um direito fundamental nos processos integracionistas. | es-ES |
| dc.description | This work, at a first moment, approaches the free competition in the communitarian environment under the perspective of the philosophy. For in such a way, it submits the free competition to the analysis of three philosophical chains, in intention to support it as a true manifestation of freedom. In a second step, corroborated by the authority of the philosophical argument, try to demonstrate that the freedom of the companies to concur during the process of economic integration between countries is part of the structure focused on communitarian order in a market economy. In this perspective, the work analyzes Assunção and Rome Treat and concludes that the limitation policy of freedom competition by regulating rules does not deny freedom as a Treats characteristic, nor as a basic right in the integration processes. | en-US |
