| dc.description | El presente trabajo analiza críticamente una sentencia en la que se aplicó a los condenados por un delito de robo con violencia, la circunstancia agravante de responsabilidad penal consistente en usar o portar armas. examinando la evolución histórica de la regulación de esta circunstancia agravante y el fundamento de su existencia, el autor llega a la conclusión de que no procede aplicarla cuando el uso o el porte del arma es lo que permite calificar el hecho como robo; si se aplicara en estos casos, se vulneraría la prohibición de doble valoración, fundada en el principio non bis in idem. Consecuentemente, afirma el autor que en el fallo comentado se ha incurrido en un error de derecho. | es-ES |
| dc.description | The present work analyses, from a critical standpoint, a judgement in which an aggravating circumstance, criminal liability for possession or carrying of weapons, was applied to the parties declared guilty for robbery with violence. by examining the historical evolution of the regulation of this aggravating circumstance and the basis of its existence, the author came to the conclusion that it is not admissible to apply it when the possession or the carrying of weapons is what allows that the fact be qualified as robbery; if it was applied in these cases, the prohibition of double jeopardy, based on the non bis in idem principle, would be infringed. Hence, the author asserts that a legal error was incurred in this specific judgement. | en-US |
