El presente estudio busca dar cuenta de la forma en que el Derecho del Trabajo ha comenzado a reconocer la creciente demanda para armonizar trabajo y vida familiar. El análisis pretende contribuir al perfeccionamiento de la normativa laboral chilena en orden a que ésta pueda efectivamente materializar la igualdad de trato y de oportunidades en la vida laboral entre hombres y mujeres, cuestionando el arquetipo del hombre proveedor y la mujer cuidadora que se impone a comienzos del siglo XX, proponiendo en su reemplazo un modelo de corresponsabilidad de trabajadores y trabajadoras en el trabajo y en el cuidado de la familia. Desde esta perspectiva, el permiso parental como derecho laboral irrenunciable a favor del padre es una medida básica que puede potenciar el cambio social necesario para hacer realidad una efectiva conciliación de trabajo y vida familiar entre hombres y mujeres.This study attempts demonstrate the way in which the Labor Law has started to recognize the increasing demand to reconcile work and family life. The analysis attempts to contribute to the improvement of the Chilean labor norms in order to effectively materialize equal labor treatment and opportunities between men and women, questioning the archetype of man as provider and woman as caregiver, which has been imposed since the beginning of the 20th century. As a replacement, a model of co-responsibility of male and female workers at work and when taking care of the family is proposed. Form this perspective, the parental leave as an inalienable labor right on behalf of the father is a basic measurement which can empower the necessary social change to materialize an effective work/family life balance between men and women.
