El trabajo examina cómo se llega a personificar las sociedades civiles en el proceso de la codificación española y por qué existe una intensa polémica doctrinal a ese respecto en España. Históricamente, la conexión entre sociedad civil y personalidad jurídica no existió por regla general. Sin embargo, en el momento de codificarse se conectó ambas nociones, de modo que intentar configurar de modo diferente sus relaciones, hoy puede parecer una pretensión de dificultar el tráfico económico, porque está muy arraigada la idea de que la sociedad civil, para que opere adecuadamente en el mercado, debe obrar como persona jurídica. Además de estudiar cómo se llegó a establecer la personalidad de las sociedades en el Código Civil, se examinará la reforma introducida por la Ley de sociedades profesionales, que modificó en algo esta cuestión.This work examines how identity was established for civil partnerships in the codification process in Spain and why there is an intense doctrinal controversy in this respect in Spain. Historically, as a general rule, the connection between civil partnership and legal identity did not exist. However, when they were coded, both concepts were connected, in order to try to configure their relationships in a different way. Today this can seem like an intention of hindering economic flow, because the idea that a civil partnership must function as a legal entity in order to adequately operate in the market is so rooted. In addition to studying how the identity of partnerships was established in the Civil Code, the reform initiated by the Law of Professional Partnerships, which somehow modified this topic, will be examined.
