El presente trabajo efectúa un examen crítico al tipo de obtención fraudulenta de prestaciones estatales regulado en el numeral 8 del artículo 470 del Código Penal chileno, también conocido como "fraude de subvenciones" a nivel doctrinal. Con este objeto, se analiza el bien jurídico protegido por dicha figura, la conducta típica sancionada, la consumación y las formas imperfectas de ejecución, las posibles causales de justificación de la misma, la penalidad aplicable y las relaciones concursales existentes entre ésta y otros tipos penales. Finalmente, se plantea, la necesidad de dotarla de una regulación autónoma y diferenciada -fuera de las disposiciones atingentes a la estafa-, que ponga de relieve el interés que ella protege y sea coherente con las normas relativas a otras figuras penales protectoras del patrimonio fiscal.This work critically analyzes the type of fraudulent acquisition of state benefits regulated in number 8 of article 470 of the Chilean Criminal Code, also known as "subsidy fraud" at the doctrinal level. With this purpose, the juridical right protected by this doctrine, the typical sanctioned conduct, completion and the imperfect forms of execution, possible causes of justification, applicable punishment and the existing bidding relationships between this one and other criminal types are analyzed. Finally, the need of providing an autonomous and differentiated regulation-outside the disposition related to fraud-is raised, in order to point out the interest protected by it and so that it is coherent with the rules regarding other criminal concepts protecting the fiscal patrimony.
