| dc.description | El trabajo se propone determinar la cadena de responsables por defectos y fallas en el proceso constructivo de obras y establecer los legitimados pasivos y el fundamento de su responsabilidad; afirmando la naturaleza objetiva de dicha responsabilidad, que es posible excluir merced a la entrega de una obra exenta de defectos y a la fuerza mayor, noción que se contrasta con el fenómeno natural del sismo o terremoto, pues se distingue la ocurrencia del mismo y sus consecuencias, para dilucidar su aplicación o exclusión como causa de exoneración. | es-ES |
