La Ley N° 19.657: Sobre concesiones de energía geotérmica, de 2000, junto con crear la concesión de energía geotérmica, permitió su hipoteca. No optó, pues, por establecer una prenda sin desplazamiento de tal concesión, en seguimiento de varias leyes anteriores sobre concesiones, que habían configurado sendas prendas, pese al carácter inmueble de los objetos sobre que estatuyeron. Como la concesión de energía geotérmica tiene carácter inmueble, fue más técnica la ley de 2000 al crear, pues, una hipoteca. Con posterioridad, la Ley N° 20.434, de 2010, introdujo en la Ley N° 18.892, de 1989: General de pesca y acuicultura, también la figura de una hipoteca de la concesión de acuicultura que había sido creada por esta última. Ambas hipotecas configuran un género de estos gravámenes, caracterizado por tener como objeto unos derechos reales administrativos inmuebles; a cuyo estudio queda dedicado el presente trabajo.Law No. 19.657: On geothermal energy franchises, of 2000, together with creating the geothermal energy franchise, allowed its hypothecation. It did not choose, then, to establish a security without the movement of such franchise, abiding by several previous laws about franchises that had shaped both securities, despite the immovable nature of the objects about which they enacted. As the geothermal energy franchise has an immovable nature, the law of 2000 was more technical when creating a hypothecation. Subsequently, Law No. 20.434 of 2010, introduced in Law No. 18.982 of 1989: General Law of Fishing and Aquaculture, also the figure of a hypothecation of the aquaculture franchise that had been created by the latter. Both hypothecation shape a type of these taxes, characterized for being aimed at immovable administrative rights in rem. This article is about this study.
