In thisanalysis of jurisprudence, is checked a judgment dictated by the Court ofAppeals President Aguirre Cerda, judgment that meant a contribution of thescience of the Law to less, to including the beginning of the natural equityas principal foundation.El instituto de la equidad natural, constituye un tema trascendente en materia jurídica, pues, la misión de este gran principio es corregir los vicios o defectos de lo justo positivo, a fin de obtener una solución más adecuada al caso sometido a la decisión del tribunal. En este análisis de jurisprudencia, se revisa un fallo dictado por la Corte de Apelaciones Presidente Aguirre Cerda, sentencia que significó un aporte de la ciencia del Derecho a lo menos, al incluir el principio de la equidad natural como principal fundamento.
