Based on Niklas Luhmann’s systems theory, the article explores the extension of the semantics of human rights to non-human individuals in modern society. Drawing on judgments and legal texts, the extension of these rights to animals, flora and fauna, and technology is analyzed. The article concludes that the main issue lies not in the definition of the human being for the human rights, but rather in knowing what is the meaning of the human being in the particular communication established by the legal system. Neither body, nor mind nor communication are the definitive home of the human being. He can be in any of them, or in all three at the same time, depending on the observation.Sobre la base de formulaciones de la teoría de sistemas de Niklas Luhmann, el artículo investiga la ampliación de la semántica de los derechos humanos a individuos no humanos en el contexto de la sociedad moderna. Por medio de referencias a sentencias y textos jurídicos, se analiza el caso de la extensión de estos derechos a los animales, la flora y fauna y la técnica. El artículo concluye que la cuestión principal no está en la definición del ser humano para los derechos humanos, sino más bien en saber cuál es el sentido del ser humano en la comunicación específica establecidapor el sistema jurídico. Ni cuerpo, ni mente ni comunicación son el hogar definitivo del ser humano. Él puede estar en cualquiera de ellos, o en los tres al mismo tiempo, dependiendo de la observación que sea hecha.
