El presente artículo efectúa un análisis de la Ley N° 20.823, de 2015, que modifica el Código del Trabajo en materia de jornada laboral, partiendo de una síntesis de la historia del establecimiento de dicha ley, así como una revisión crítica de la jurisprudencia administrativa dictada en atención a dicha normativa. En particular, el autor pone en tela de juicio la doctrina de la Dirección del Trabajo, consistente en la prohibición de modificar unilateralmente el sistema de turno establecido en el reglamento interno, para adecuarlos a la nueva legislación, a menos que cuente con el acuerdo del trabajador.This article makes an analysis of the Law N° 20.823 of 2015, amending the Labor Code regarding working hours, based on a synthesis of the history of the establishment of this law, as well a critical review of administrative jurisprudence issued in response to that legislation. In particular, the author puts into question the doctrine of the Labor Direction, consisting in the ban to unilaterally change the shift system established in the internal regulations, to adapt those to the new legislation, unless the Direction counts with the agreement of the employee
