| dc.description | Carl Schmitt argues that law can be conceived as a rule, decision or order. These ways of understanding the law are not exclusive but indicate a priority: one of them will play the central role and articulate to others. In this article, it will be examined which of these ways of understanding the law is central to the legal philosophy of Thomas Aquinas, for what it is concluded that the fundamental meaning of ius is "order". Indeed, for Thomas the meaning of law is, in the first place, the ipsa res iusta. However, the other meanings are also part of his legal theory. Specifically, law may also be understood as a "norm", since law is not the ius but a certain "cause" of it. The law is also envisioned as "decision" by Aquinas, whose role is observed in the process of determination. | en-US |
| dc.description | Carl Schmitt sostiene que el derecho puede ser concebido como regla, como decisión o como norma. Estos modos de entenderlo no son excluyentes, sino que indican una prioridad, pues necesariamente uno de ellos desempeñará el papel central y articulará a los otros. En este trabajo se examina cuál de esos modos de entender el derecho es el central en la filosofía jurídica de Tomás de Aquino, y se concluye que es el de “orden”, atendido que para Tomás el derecho es, en primer lugar, la “cosa justa”. Se muestra, sin embargo, que las otras acepciones también tienen un lugar en su teoría jurídica, concretamente la de “norma”, pues la ley, si bien no es el derecho constituye una cierta “razón” del mismo, y la de decisión, cuyo papel se observa en el proceso de determinación del derecho. | es-ES |
