Abstract
This article analyzes jurisprudence of the so called internal replacement of strikers, comparing criteria of the Supreme Court with those used by judges in the new Chilean Labor Law.
 
Este trabajo analiza la jurisprudencia sobre la denominada sustitución interna de huelguistas, comparando los criterios de la Corte Suprema con aquellos utilizados por los jueces de la nueva justicia laboral chilena.
