Abstract
This work reveals the contribution of the distinguished Romanist Alejandro Guzmán Brito to the modern dogmatics of Chilean securities market law, perhaps the most unknown area of his research. The review of his publications on the right of pledge in Chilean law, written in his last decade of investigative work, allows after carrying out a chronological and systematic review of them, to identify the existence of a line of research in which, from the study of the garment without displacement, it is introduced into the dogmatic analysis of securities, their dematerialization. These studies allow him to formulate a new notion of negotiable securities and the guarantees that can be established over them, being able to identify that modern guarantees on negotiable securities or financial instruments, dematerialized or without material support, were already recognized in Roman law classic but that had lost their original conception during the evolution of continental commercial law, particularly in French law, allowing the pledge without displacement was allowed by exception, but as more cases are incorporated it becomes a general rule, which for Guzmán Brito is to return to the notion of Classical Roman law on pledge and mortgage. Este trabajo revela el aporte del eximio romanista Alejandro Guzmán Brito a la moderna dogmática del derecho del mercado de valores chileno, quizás el ámbito más desconocido de las investigaciones de Alejandro Guzmán, en que desde sus publicaciones sobre el derecho de prenda en el derecho chileno, escritas en su última década de trabajo investigativo, es posible, luego de realizar una revisión cronológicas y sistemática de estos, identificar la existencia de una línea de investigación en que a partir de la prenda sin desplazamiento le lleva al análisis dogmático de los títulos valores, su desmaterialización y una nueva noción de valores negociables y de las garantías que es posible constituir sobre ellos, pudiendo identificarse que las modernas garantías sobre valores negociables o instrumentos financieros desmaterializado o sin soporte material, ya eran reconocidas en el derecho romano clásico pero que habían perdido su concepción original durante la evolución del derecho mercantil continental, particularmente en el derecho francés, permitiéndose que la excepción de la prenda sin desplazamiento, se transforme en una regla general, lo que es volver a la noción del derecho romano clásico sobre prenda e hipoteca.
