| dc.description | La compensación económica es una institución nueva en el derecho matrimonial chileno que presenta dificultades para su interpretación. La doctrina no es unánime al momento de determinar su naturaleza jurídica y los jueces al momento de establecer su procedencia se dividen entre quienes exigen el cumplimiento de los supuestos objetivos y subjetivos del artículo 61 LMC. y quienes prescinden de los elementos subjetivos. Al momento de la cuantificación no existe una vinculación a los supuestos de procedencia y son fijados con una visión asistencial muy cercana a la pensión de alimentos. La institución requiere de una revisión y debe incorporarse el supuesto del cónyuge que contribuyendo económicamente al hogar, igualmente se preocupa de los hijos y del hogar común y al momento del divorcio en una visión económica global es el cónyuge más débil. | es-ES |
| dc.description | Settlement presents some interpretation problems as a new institution in the Chilean marriage law. The doctrine is not unanimous upon determining its juridical nature and the judges, upon establishing its legitimacy, can be classified into those who demand the compliance with the objective and subjective assumptions in Art. 61 LMC and those who disregard subjective elements. In quantifying, there is no link with the legitimacy assumptions, and they are established with a welfare-like perspective very close to alimony. This institution calls for a review, and the following assumption must be incorporated into it: in a global economic view, the spouse who gives support equally looks after the children and the common home and is the weaker of the two spouses when divorce comes through. | en-US |
